General conditions

1. General

1.1. These conditions apply to all deliveries. Any order implies acceptance of the terms and conditions of sale.

2. Delivery and dispatch

2.1. Delivery takes place while stocks last.

2.2. Orders are shipped between Monday and Friday, excluding legal holidays. Javana is not responsible for unpredictable delays. The products are delivered a maximum of 30 days after the order day, unless there is a case of force majeure.

2.2. The articles are sent according to the shipping costs overview per country and at the risk of the customer to the delivery address specified by the customer.

2.3. If it is impossible to deliver the articles, the agreement will be terminated by operation of law. The seller is obliged to inform the customer in writing before the expiry of the delivery period. In the event of partial delivery, each delivery will be regarded as a separate sale.

2.4. Subject to proof to the contrary, the obligation to deliver will be fulfilled as soon as the goods delivered by the seller have been offered to the buyer once. In the case of home delivery, the carrier's report, containing the refusal of acceptance, serves as full proof of the offer of delivery.

3. Price

3.1. Javana cannot guarantee the complete absence of errors on the shop. The shop may contain typographical errors, errors and inaccuracies relating to the price, availability or details of an item. No liability is accepted for the consequences of such errors.

3.2. Javana makes every effort to ensure that prices are accurate, but cannot guarantee that there are absolutely no errors in the prices. In the event that there is an error in the price of a product, Javana will allow the customer to accept the new price or cancel the order. If Javana is unable to contact the customer within 30 days, the order will be canceled automatically.

3.3. Prices quoted are current at the time of publication, after which they may be subject to change. Shipping costs are not included in these prices, but Belgian VAT (21% or 6%) is included.

3.4. All prices are per item, unless stated otherwise.

3.5 If a product that has already been purchased appears to be discounted shortly after a product has been purchased, the customer cannot claim a refund of the price difference.

3.6. Javana is not responsible for any kind of customs fees or taxes that may be applied after shipment.

3.7. Javana reserves the right to correct errors or inaccuracies, even after an order has been placed. Consequently, Javana reserves the right to rectify errors or inaccuracies on the shop without prior communication of any kind.

4. Right of withdrawal

4.1. In the event of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the consumer has the right to inform the seller that he renounces the purchase, without payment of a fine and without stating reasons. within 14 working days from the day following the delivery of the goods. Before proceeding with the return, the buyer must report this via the contact form or e-mail. Returns must be made in the original packaging (including associated accessories and any documentation) and must be in new condition.

4.2 Items purchased during the sales period cannot be returned.

5. Complaints or disputes

5.1 . Complaints or disputes must be reported within 14 days of delivery. If the complaint is found to be well-founded, our liability is limited to the exchange of the goods. Any liability of the seller is limited to the amount actually paid for the order.

6. Returns

6.1. The goods can be returned up to a maximum of 14 days after receipt. The goods can under no circumstances be returned or refunded in an offline store.

6.2. Javana recommends using a courier when returning goods in order to be able to track the package.

6.3. Javana will not be held responsible for a refund of goods that are lost, stolen or damaged.

7. Delinquent Payments

7.1. In the event of late payments, interest will be charged on the outstanding invoice amounts by operation of law and without any prior notice of default being required at the rate of 1% per month from the invoice date. In the event of non-payment and if a reminder by ordinary letter has not been followed up for 14 days, a fixed compensation amounting to 10% (ten percent) of the outstanding amounts with a minimum of € 50 (fifty euros) and a maximum of € 2,000 (two thousand euros).

8. Property right

8.1. The seller remains the owner of all goods until full payment is made.

9. Applicable law

9.1. Only Belgian law applies to these sales conditions and, more specifically, the courts of the district of Bruges.
